Violations cited in this report must be corrected within the time frames below, or as stated in section 8-405.11 of the food code.
If the licensee fails to correct a violation on or before the correction date, an administrative fine may be imposed.
The licensee has 30 days from the date of this inspection report to request an appeal of any violation cited in the inspection report. A written request for an appeal must be addressed to the Director, Rhode Island Department of Health, 3 Capitol Hill, Room 401, Providence RI 02908. Failure to request an appeal within 30 days constitutes an admission of the violation and a waiver of all legal rights to contest any violation. A hearing on the appeal will be held in accordance with the provisions of Chapter 35 of Title 42 of the Rhode Island General Laws and Practices and Procedures before the Rhode Island Department of Health, available at https://rules.sos.ri.gov/regulations/216-10-05-4 or by request from this office.
10 Violation of Code: [5-204.11] The Ice Cream/Bodega and the Silk Rhode areas are lacking a hand-washing sink. Per the PIC, the area where ice cream and smoothies are made was recently used for prepackaged items only. The change to the area for food service (ice cream and smoothies) now requires a hand sink that is located for convenient use by the employees. Hand sinks are to be installed. Per the PIC and Maintenance staff, hand sinks installation work order was placed. PIC to contact inspector when installation is completed.  New Violation. Correct By: 06/30/2025
33 Violation of Code: [3-501.15] Proper cooling methods were not used for time/temperature control for safety (TCS) foods. Per interview of the PIC, cut breaded chicken was placed hot in the walk-in cooler in covered containers greater than four inches deep. Chicken was re-panned in shallow pans for rapid cooling at the time of inspection.  Repeat Violation. Correct By: 11/21/2024
38 Violation of Code: [6-501.111] The presence of rodents is not controlled as evidenced by droppings along the walls behind the fryolator area. The presence of insects, rodents, and other pests must be controlled by routinely inspecting the premises for evidence of pests, using acceptable methods to control pests, eliminating harborage conditions, and routinely inspecting incoming shipments of food and supplies. Per the PIC, pest control currently inspects 2 times weekly. PIC is to monitor and inform pest control of any changes in rodent activity.  New Violation. Correct By: 11/21/2024
55 Violation of Code: [6-501.12] The floor and wall in the Grill Fryolator and Reach-In Cooler area was observed to have an accumulation of soil residue, food debris, and rodent droppings. The physical facilities shall be cleaned as often as necessary to keep them clean and to aid in the current pest control program.  Repeat Violation. Correct By: 11/21/2024
55 Violation of Code: [6-501.11] At the time of inspection, the ceiling in the kitchen and back storage areas were observed in poor repair. Several ceiling tiles were observed to be stained with water stains, and a rain/leak catch system was observed to have a hose used to direct water into a bucket on the floor. Per the PIC, the roof does leak during rain events (no leak observed at time of re-inspection). The physical facilities must be maintained in good repair.  Repeat Violation. Correct By: 06/30/2025
